Lindsay Clancy’s lawyer, Kevin Reddington, has denied claims suggesting she’s going to be testifying in Patrick Clancy’s civil case

Patrick’s attorney, Howard Cooper, told the judge in a Massachusetts courtroom on Wednesday, Oct. 28 that he expected Lindsay to testify once her criminal case wrapped up

However, Reddington has since insisted, “She never indicated that she intended to testify in Mr. Clancy’s lawsuit, and no one acting for her ever represented that she would. Mr. Clancy’s counsel does not speak for Lindsay Clancy”

Lindsay Clancy‘s lawyer is denying claims that she’s planning to testify in her ex-husband Patrick Clancy‘s civil case.

Patrick previously filed a wrongful death lawsuit on behalf of his three children — Cora, 5, Dawson, 3, and 8-month-old Callan — whom Lindsay admitted to strangling on Jan. 24, 2023 in the family’s Duxbury, Mass., home, before attempting suicide.

Patrick is suing a psychiatrist and a nurse practitioner who treated Lindsay in the months before the killings. Lindsay’s defense has argued that she was suffering from postpartum psychosis when she killed her children and that she had been failed by medical providers after seeking help for mental health concerns.

Attorneys for the medical providers want the lawsuit dismissed. However, as attorneys for Patrick and the defendants appeared in a Massachusetts courtroom on Wednesday, Oct. 28, for a hearing that was streamed live by Court TV, Patrick’s lawyer, Howard Cooper, insisted he wanted the case to proceed.

Cooper also told the judge he expected Lindsay to testify once her criminal case wrapped up.

“We believe that Lindsay Clancy, once her Fifth Amendment issues are resolved one way or the other, will testify that she told these defendants explicitly that she had homicidal ideation, that she was worried about something awful happening to her kids,” Cooper said, per CBS Boston.

Lindsay’s attorney, Kevin Reddington, however, insisted that his client had never suggested that she wanted to testify in the case.

In a statement obtained by PEOPLE, Reddington said, “It has come to my attention that counsel for Patrick Clancy represented to the court in his civil case that my client, Lindsay Clancy, will testify about statements she made to her healthcare providers.”

“Lindsay Clancy never told any of her healthcare providers that she harbored homicidal ideation toward her children,” Reddington added.

“She never indicated that she intended to testify in Mr. Clancy’s lawsuit, and no one acting for her ever represented that she would. Mr. Clancy’s counsel does not speak for Lindsay Clancy,” he continued.

PEOPLE has contacted attorneys for Patrick for comment.

Lindsay’s first murder trial ended in a mistrial almost two months ago.

The next major hearing in the case is set for Monday, Nov. 2, when Lindsay and her attorney, Reddington, will appear in Plymouth Superior Court to argue in support of a motion to have the charges against Lindsay dismissed on the grounds of double jeopardy.

If Judge William Sullivan grants the motion, the criminal charges against Lindsay could be dismissed, potentially preventing prosecutors from retrying her on all charges related to the deaths of her three children.

But if Judge Sullivan dismisses the motion, Lindsay could find herself facing another murder trial.

If the judge denies Lindsay’s motion, the Plymouth County District Attorney’s Office will then have to decide whether to pursue a second trial, negotiate a plea deal or drop the charges. Prosecutors have not publicly announced how they intend to proceed.

Patrick, meanwhile, has claimed in his wrongful death lawsuit that Lindsay was prescribed at least nine medications in the months before she allegedly strangled their three children, including: fluoxetine (“Prozac”), zolpidem tartrate (“Ambien”), mirtazapine (“Remeron”), clonazepam (“Klonopin”), quetiapine fumarate (“Seroquel”), diazepam (“Valium”) and lamotrigine (“Lamictal”).

In his suit, which was obtained by PEOPLE, Patrick wrote that he believed Lindsay killed their children because she “started hearing a compelling and unrecognizable singular male voice that told her ‘this is your last chance’ and that she had to ‘take them’ with [her].”

It was that same voice that “indicated to [Lindsay] that she should die ... and that her children would suffer if she was gone,” according to the lawsuit.

Lindsay is also suing a number of her medical providers, but in her case for medical malpractice.

The couple’s two oldest children — Cora, 5, and Dawson, 3 — were pronounced dead soon after arriving at the hospital, and the youngest, 8-month-old Callan, died a few days later.

Lindsay’s attorney Andrew Meyer previously told PEOPLE that Lindsay’s lawsuit alleged her medical providers responded to her psychiatric struggles by “changing and increasing her medication” while failing to recognize the “actual diagnosis and problems she was having.”

The case will go before a tribunal, as is standard practice in Massachusetts once all of the defendants have filed replies to the initial complaint.

Lindsay was hospitalized following the January 2023 incident, before being taken to Tewksbury Hospital, where she is still in custody.
